PRODUCT LISTING POLICY
Definitions
“Seller” means the product seller and for the purposes of this he is engaged in the activities such as export, sales, distribution, packaging, labeling, installation, repair & maintenance or any such activity which puts the product for the commercial purpose.
“Intellectual property” – For the purposes of this policy means any patent, copyright, trademark, trade name, service name, brand name, logo, industrial design, any registrations thereof and pending application thereof (to the extent applicable), or any other intellectual property rights (including without limitation, any trade secret, consumer or membership list, any marketing data, software data) or license (including the license to use certain website, phone number or radio channels) related to any goodwill associated with business owning or holding
“Applicable laws” – For the purposes of this policy shall mean laws in India, which shall include all statutes, and enactments, including but not limited to acts of legislature or parliament, ordinances, rules, bye-laws, regulations, notifications, guidelines, policies, directions, directives, orders, requirements, or other governmental restrictions or any similar form of a decision of, or determination by, or any interpretation, policy or administration of, any government, statutory authority, tribunal, board, or court having jurisdiction over the matters mentioned in this policy.
“Prohibited Items” – For the purposes of this policy shall mean all the products mentioned in the clause.
Naayatrade owns, operate and has absolute intellectual property rights over the Website Naayatrade.com and Applications (website, application, marketplace)
Please read the following Conditions carefully (collectively referred as “Seller’s policy”). This policy describes the terms that the seller needs to adhere before listing any product or service on the Website/Application/Marketplace (hereinafter refer as Platform) of Naayatrade.
that he shall adhere to all the terms mentioned below. The seller agrees to not to sell any product or service which is illegal under the applicable laws of India.
that he shall make sure that such product or such service is NOT against the Naayatrade Seller’s Policy. As a member of the Naayatrade it shall be solely responsible for ensuring that products or services are of legal nature.
that Platform reserves a right to remove the product without providing the intimation to the users. Naayatrade also reserves the right to remove the account of any member who continues to violate the Seller’s Policy after being warned. If the seller has made any sale through the Platform of any illegal product, then such sale will stand canceled and strict action will be taken against the Seller.
that Platform doesn't permit selling of any such product or service which is illegal or can be used for illegal purposes, and infringes the intellectual property.
Prohibited Items
The list of products which are prohibited to be listed on the Naayatrade website.
2.1 Illegal drugs, Precursors and drug paraphernalia
All the drugs, psychotropic drugs, steroids and all other regulated substances which are barred from listing or sale.
Any product of illicit drugs including but not limited to heroin, cocaine etc which is barred from listing or sale.
2.2 Medical Drugs and Devices
Any such drugs, psychotropic drugs and narcotics which need the prescription is strictly prohibited.
The listing of or sale of any such medicines which if orally administered or ingested leads to the sexual enhancement is strictly prohibited
2.3 Intellectual Property Rights (IPR) Infringing Products
Unauthorized duplicate products which can directly leads to the IPR infringement are prohibited from being listing or selling through the Naayatrade platform
2.4 Metals & Minerals
Metals such as gold & silver or other precious metals in any form other than the jewelry is prohibited from being listed & sold. In regards to the gold & the silver jewelry, hallmarking of the metals should be as per the standards set by the Bureau of Indian Standard.
2.5 Financial & Monetary aid
Any kind of service which aids any monetary transaction such as money transfer, withdrawal, conversion of currency, banking assistance (Receive checks and cash for deposit, verify amounts and check accuracy of deposit slips count daily inventories of cash, drafts, checks etc) are strictly prohibited to be listed or provided through the Naayatrade platform.
2.6 Other Prohibited Items
Apart from the above mentioned items, any such products which are illegal, prohibited, banned, forbidden or restricted under the applicable laws falls under the “prohibited items”.
2.7 Pornographic, violent, obscene or vulgar materials
Naayatrade prohibits the listing and the sale of the following:
Any such material which, if generally defined or understood as per the applicable laws, is pornographic, violent, vulgar or obscene in nature.
Any item which encourage, depicts, suggest sexual abuse, rape, unnatural sex, or sex involving minors or any such graphic representation which degrade the life of living being or animals.
Such adult toys & dolls which contains sexual explicit images in its product descriptions, images (including but not limited to dummy or stimulated genitals)
Any such product which in any manner promotes violence or vulgarity.
Providing any such services which directly or indirectly leads the encouragement, suggestion or depiction of prostitution
The seller further agrees that if Naayatrade finds any product or service violating the above restrictions, it reserves an exclusive right to remove such material from the website and if the seller continues to post such products, in such a situation Naayatrade reserves the right to cancel the membership.
2.8 WEAPONS
Any such products (including but not limited to crossbow, axe, hunting knives, gauge knives, metal knuckles) which poses the ability to cause bodily harm, hurt or grievous hurt, death to any person or any kind of harm to human life are prohibited from listing or sale through Naayatrade.
2.9 Human Parts, Human remains & Protected Flora & Fauna
The commercial dealing in human organs and tissues prohibited under the Transplantation of Human Organs & Tissues Act, 1994 is prohibted
Buying and selling of flora & fauna or parts of such flora & fauna which under the Wildlife Protection Act, 1972, Biological Diversity Act, 2002 is prohibited.
Change in the Product Listing Policy
Any changes to the product listing policy will be communicated through this page. The users shall be notified via email, prominent notice or through any such medium use by this platform. Users are advised to check this page from time to time for any new updates. The effective date of the updated policy shall be the date when the policy is updated on the website.
